Sunrise Cottage – Guest Rental Agreement
This agreement is between Robert & Elizabeth Stygall (the Host) and the person who makes the
booking (the Guest) for a short-stay holiday at Sunrise Cottage, [438 Kallista-Emerald Road, Victoria 3791.
By paying the deposit or booking amount, the Guest accepts these terms on behalf of everyone in their group.
1. Nature of the stay
This is a short-term holiday licence to occupy the Cottage for the dates booked. It is not a residential tenancy, and the Residential Tenancies Act 1997 (Vic) does not apply. Stays are for fewer than 28 nights unless agreed in writing. Arrival date, departure date, number of guests and total price are as shown in the booking confirmation.
2. Payment
50% of the total is payable at booking and the balance 7 days before arrival. The total price includes the Victorian Short Stay Levy (7.5%) and any cleaning fee, and is shown before the Guest pays.
3. Security deposit
A security deposit of $200 is secured at booking 1 day before arrival. The Cottage is presented clean, tidy and in good repair, and the Guest must leave it in a similar condition, allowing for fair wear and tear.
The Host may retain all or part of the deposit to cover the reasonable cost of:
repairing or replacing anything damaged, broken or missing during the stay;
additional cleaning if the Cottage is left messy or untidy beyond normal use,
for example excessive rubbish, dirty dishes, stains, items damaged or removed.
The Security deposit may be retained for any breach of the house rules, refer item 4 below.
If the Host retains any amount, the Guest will receive an itemised statement with photos and receipts as appropriate, or quotes within 7 days of departure.
The balance is refunded within 2 days of departure, if conditions have been complied with. If costs exceed the deposit, the Guest agrees to pay the difference.
The Guest should report any pre-existing damage or cleanliness issues within 2 hours of arrival so they are not charged for them.
4. House rules
No smoking or vaping indoors. No parties or events. No loud music. Quiet hours are 10:00 pm–8:00 am.
Pets only with prior written approval. Guests must follow the house manual, keep doors locked when out, and comply with any fire restrictions or emergency directions.
Do not tamper with smoke alarms.
5. Cancellation
Monies paid are non-refundable. In exceptional circumstances (genuine emergencies etc), refunds will be made but solely at the discretion of the host.
6. Australian Consumer Law
Nothing in this agreement limits the Guest's rights under the Australian Consumer Law.
7. Liability and access
Guests use the Cottage, grounds and facilities at their own risk, to the extent permitted by law. The Host is not responsible for loss of guests' personal belongings. The Host may enter with reasonable notice for urgent repairs, or without notice in an emergency.
The Host may end the stay without refund for serious breach of these terms, such as dangerous behaviour, excess guests or significant damage.
8. Privacy
Guest details are used only to manage the booking and meet legal obligations, and are not shared except as required by law.
9. Acceptance
By paying monies for the booking of accommodation the Guest accepts the Term and Conditions herein.
